1. Introduction

Use by you of this web site ("nvqlearning.com") is conditional upon your acceptance of the following terms and conditions. These terms and conditions and our Privacy Policy, (together comprising the “User Agreement”) form our entire agreement with you in respect of the non-chargeable use of nvqlearning.com and supersede any prior agreement with you in respect of nvqlearning.com. If a company name is included in your application for registration, then the User Agreement shall be between us and that company and accordingly unless the context otherwise requires, references to "you" and "your" in this User Agreement shall also be to that company. The purchase of services from us is subject to our Terms and Conditions of Purchase, copies of which are available from our offices or via e-mail upon request. If there are any significant updates to this User Agreement or to the Terms and Conditions of Purchase, we will bring this to your attention on the home page of nvqlearning.com.

2. Availability of nvqlearning.com

We will endeavour to ensure that nvqlearning.com is available 24 hours per day without any interruptions. However, we reserve the right to make nvqlearning.com unavailable at any time or to restrict access to parts or all of nvqlearning.com without notice. nvqlearning.com is a general information service. 9. Our liability

Save as provided below, we disclaim all and will not be liable in contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or nvqlearning.com for: (i) consequential, indirect or special loss or damage; or (ii) any loss of goodwill or reputation; or (iii) any economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case, even if we have been advised of the possibility of such loss or damage and howsoever incurred.

Our maximum liability to you in contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or nvqlearning.com shall be limited to £50. Notwithstanding any other provision of this User Agreement, we will be liable to you without limit for any death or personal injury caused by our negligence and to the extent that liability arises under Part 1 or section 41 of the Consumer Protection Act 1987 and for liability arising from statements made fraudulently by us.

You agree to indemnify us and keep us indemnified against all costs, claims, expenses, losses, liabilities or proceedings arising against us from use or misuse by you of this site.

Nothing in this User Agreement affects your statutory rights as a consumer.

10. Termination

Either of us may terminate this User Agreement at any time. You may not transfer any of your rights or delegate any of your obligations under this User Agreement without our prior written consent.

11. Enforcement

If we fail to enforce any provision of this User Agreement, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion. Nothing in this User Agreement shall confer on any third party any benefit or the right to enforce any term of the User Agreement.

12. Jurisdiction

This User Agreement is governed by English law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the English courts.

b) PRIVACY POLICY

1. Data Protection

Manley Summers Group is committed to providing our candidates and clients with a secure and confidential service that conforms to our obligations under the provisions of the Data Protection Act (1998). Any information you submit to Manley Summers Group will only be used in accordance with the purposes stipulated in this document and will at no time be sold or distributed to third parties.

2. Clients

Company and/or personal information including your name, address, email address, phone number or any other information pertaining to you or your company will be stored on our system in order to provide us with an easy means of communicating with you and may be utilised in the following ways:

To contact you about current vacancies you have with Manley Summers Group
To provide you with additional information on our candidates
To send you relevant Manley Summers Group news and information

3. Candidates

Personal information including your name, address, email address, work and education history, skills, or any other information pertaining to your experience and/or education as well as sensitive information that we may be required to collect by law (which may include nationality, ethnic origin, religious beliefs and physical or mental health) will remain on our system in order to be utilised in the following ways:

To identify if you are suitable for vacancies
To provide additional information to our clients (e.g. work history)
To inform you of relevant news or information if applicable (e.g. jobs by email)

Your CV may be available online to registered authenticated clients of Manley Summers Group in order to help promote you in an efficient manner but will not be made publicly available. Clients will not have access to your address or contact information without your prior permission.

We may also collect information in the aggregate in order to provide us with better overall information on the users of our website but this will not include personally identifiable data. Aggregate data may be shared with third parties but no individual information is disclosed.

4. Consent

By using this website, you consent to us processing your information for the purposes of providing you with our services and maintaining our records. You also consent to your data being disclosed to prospective employers or to any person, firm or company to whom we sell the whole or a substantial part of our business or to whom we may transfer any part of our rights or obligations. You also consent to the sharing of aggregate information with selected third parties.

At present, the option of storing candidates CV's within our database exists, and at this time no option exists for third parties to access this database. If a decision is made to change this aspect of the site then we will seek your consent first. While all reasonable security measures have been implemented, we are unable to accept responsibility for intrusion by third parties acting illegally.

If Manley Summers Group amends its Privacy Policy the changes will be posted on this page, and if substantial may be published on the Home Page of this website or through e-mail notification.
